Welcome to NextCloud. These Terms of Service (“Terms”) govern your access to and use of NextCloud’s web hosting, VPS, dedicated servers, domain registration, email hosting, and WordPress hosting services (“Services”). By creating an account or using our Services, you agree to these Terms.
2. Company Information
NextCloud (“we”, “us”, “our”) is an Australian-based hosting provider located in South Australia. All references to “you” or “your” refer to the customer or account holder using our Services.
3. Services Provided
We offer the following services:
- Shared web hosting
- Virtual Private Servers (VPS)
- Dedicated servers
- Domain registration and management
- Email hosting
- Managed WordPress hosting
Service specifications, limitations, and pricing are available on our website and may be updated periodically with notice.
4. Account Registration
You must provide accurate and complete information when registering. You are responsible for maintaining the confidentiality of your credentials and all activity under your account. Misuse, false information, or unauthorized activity may result in suspension or termination.
5. Billing and Payments
- Services are billed on a monthly or yearly subscription basis.
- Automatic renewal applies unless cancelled before renewal date.
- All prices are listed in Australian Dollars (AUD) and may be subject to GST.
- Accepted payment methods are listed on our website.
- Failure to pay may result in suspension or termination of Services.
6. Refund Policy
We offer a 7-day money-back guarantee for new hosting accounts (shared, VPS, and WordPress hosting).
Refunds are not available for:
- Domain registrations or renewals
- Dedicated server setups
- Violations of our Acceptable Use Policy
Refund requests must be made within 7 days of account activation.
7. Acceptable Use Policy
You agree not to use our Services for any unlawful or harmful activity, including but not limited to:
- Sending unsolicited bulk email (spam)
- Hosting or distributing malware, phishing content, or malicious code
- Infringing on intellectual property rights
- Running cryptocurrency mining operations
- Hosting adult or pornographic content
- Engaging in hacking, DDoS, or network abuse
Violations may result in immediate suspension or termination without refund.
8. Support and Maintenance
NextCloud provides 24/7 technical support via ticket and email. We aim to maintain a 99.9% uptime for all hosted services. Planned maintenance or outages will be communicated through our status page or email when possible.
9. Backups and Data
While we perform regular backups as a courtesy, customers are responsible for maintaining their own data backups. We are not liable for data loss, corruption, or recovery failures.
10. Service Suspension and Termination
We may suspend or terminate Services if:
- You breach these Terms or our Acceptable Use Policy
- Invoices remain unpaid beyond the due date
- Your activity threatens server stability or security
Upon termination, all data associated with your account may be permanently deleted.
11. Limitation of Liability
To the maximum extent permitted by Australian law, NextCloud is not liable for any indirect, incidental, or consequential damages resulting from the use or inability to use our Services. Our total liability shall not exceed the amount paid for Services during the previous billing cycle.
12. Indemnification
You agree to indemnify and hold harmless NextCloud, its employees, and affiliates from any claims, losses, or damages arising from your use of the Services or violation of these Terms.
13. Changes to These Terms
We may update these Terms periodically. Continued use of our Services after changes take effect constitutes acceptance of the updated Terms.
